Draft Law of Ukraine “On Rural Green Tourism”

ANNOTATION

². Scope and Basic Provisions

The Draft Law of Ukraine “On Rural Green Tourism” regulates relations connected with the organization and operation of the rural green tourism industry on the territory of Ukraine and defines general legal, organizational and socio-economic principles governing the implementation of the state policy in this sphere.

The draft determines conditions for the organization of green tourism activities, exercise of control of such activities etc. It gives definition of ‘sil’s’kiy zeleniy turyzm’ (‘rural green tourism’), ‘sil’s’kiy hospodar’ (‘farmer’), ‘sil’s’ka sadyba’ (‘farmstead’) thus differentiating rural green tourism services from other types of tourist services.

The draft does not include any additional requirements with regard to standardization and/or certification of dwelling premises (these should meet norms established by the current legislation for technical, sanitary and fire-prevention state of dwelling), conditions for financial provision of farmers’ civil liability and obligatory insurance of users of rural green tourism services, and licensing conditions.

It defines peculiarities of the rural green tourism activities and specifies conditions for relevant services not to be referred to entrepreneurial activities.

²². Rationale

The draft Law of Ukraine “On Rural Green Tourism” was induced by the need to ensure legislative support to activities in the sphere of rural green tourism as an important segment in the tourist industry and encourage people living in villages and small settlements to develop self-employment and business initiative, for rural green tourism may be viewed as a way to diversify income sources for rural dwellers and as an essential component of integrated development of rural areas and rural infrastructure.

²²². Existing Regulatory Framework

From the very beginning rural recreation in Ukraine received the name ‘rural green tourism’. This expression was used in a number of programming normative and legal acts and later was formalised in the laws “On Private Plot Holding” and “On Agricultural Advisory Service”. However, the above mentioned regulatory acts did not clarify the notion “rural green tourism”, nor it did the new wording of the Law of Ukraine “On Tourism”. The need in a separate law on rural green tourism is explained by the fact that tourist activities in the sphere of rural green tourism differ from the tourist/travel business on the whole, for services in rural green tourism are provided by farmers using local resources and private plot holdings, household plots and private (family) farms.

²V. Financial and Economic Justification

The draft meets requirements of the state policy on socio-economic development of rural areas and tourism and needs additional allocations from the State Budget and local budgets to design and implement relevant programmes and promote rural green tourism in Ukraine and abroad.

V. Socio-Economic Implications

Enactment of the Draft Law “On Rural Green Tourism” will have a significant socio-economic effect, for it will stimulate rural private initiative and self-employment thus facilitating improvements in rural livelihoods.
